If you are looking to buy and have found your property, allow us to look over the Contract/s.32 for any'red flags' for FREE,  
BEFORE you sign any contract!  Whether for a Private sale or attending an Auction.


SellBuy Conveyancing will go over the s.32 to make sure that the documentation is relevant to the property you have seen and confirm that it complies with your current and/or future plans. For instance, you may want to subdivide the land, however there is a covenant/restriction allowing only one dwelling on this particular property.


We will also review the Contract of Sale and if necessary, request any changes you may need, or advise you of any clauses that need to be added. 

For instance, the subject to finance clause if you are planning on getting a loan for the purchase.

Or, the subject to building and pest inspection clause.

* We will help you add these clauses in the Contract, but they must be included before you sign anything!

This will make sure that your needs are met and for your conveyancing purchase in Melbourne to be as hassle free as possible.

ALREADY SIGNED A CONTRACT?


If you have already signed a contract to purchase a property, you have come to the right place to get your Melbourne conveyancing needs completed.


If you have already made an offer on a private sale, and a Melbourne Conveyancer has not yet reviewed the Contract or Section 32, you have a 3 day cooling off period.  This means that you have 3 days to change your mind, without having to give any reason.


It is imperative that you instruct your Agent to send an initial email copy of the Contract and Section 32 Vendor's Statement to our office, without delay.

Once received, we can review the Contract and s.32 and advise you of any issues accordingly.  

You have 3 clear business days to withdraw your offer, if you choose so.

If you don't have access to email, you can always pop in to our office for a free contract section 32 review in Oakleigh.

THE NEXT STAGE


Once the cooling off period has lapsed and we have received a fully signed contract from your Agent and you have instructed our office to go ahead, the following will normally proceed.


* If obtaining a loan and there is a subject to finance clause in the contract, you have until that date to obtain finance.  If finance is not granted or your lender requires more time, we can write to the Vendor's conveyancer requesting an extension, or you can pull out of the purchase and will receive back any deposit monies already paid. 

You must instruct our office your intentions before the clause lapses.


The Vendor's conveyancer must be notified within 2 days after the finance clause date, or the Contract will automatically become unconditional and you will need to fulfill the contract, whether you can get finance or not. 


* If you had inserted a "subject to building and pest inspection" clause in the contract, please make sure that the inspection is performed within the allocated time (Generally 7 days).



ONCE THE CONTRACT BECOMES UNCONDITIONAL


WE WILL:


- Perform your Verification of Identity

- Setup the PEXA workspace and book settlement with your lender and the vendor's representative.

- Order appropriate 'current' title searches

- Apply for appropriate council and water rates certificates

-Apply for planning, land tax, Vic roads and owners corporation certificates (if applicable)

-Check certificates making sure there is no conflict with the information provided in the Vendors Statement

- Prepare 'Nomination' declarations (if required)

- Prepare the Transfer of Land

- Prepare the Statement of Adjustments and settlement statement and forward same to Vendor's representative

- Remind you to organise a time with the agent for your final inspection of the property 

 (up to 7 days prior to Settlement)

- Liaise with your Lender/You making sure that there is sufficient money available for settlement 

- Advise you of any shortfall of funds


Post Settlement


- As soon as Settlement has taken place, we will call you and your Agent.

- You can collect the keys to your property from your Agent

- Your Lender will hold the title, until the Mortgage is paid off.

- We prepare and forward a Notice of Acquisition to the Council and Water authorities, advising them that   you are the new owner.

- We will then send you a final letter, with the Statement of Adjustments and a statement of monies   disbursed including our Tax Invoice.
