So you have decided to sell your property and your agent has asked you for a Section 32 (Vendors Statement).  You have come to the right place!


Our Melbourne Conveyancing and Victoria Conveyancing services for sellers are listed in the following stages:



PRE-SALE - for Melbourne Conveyancing and Victoria Conveyancing Residential Properties.


  •  After instructing SellBuy Conveyancing to proceed, and you have responded to our questionnaire, we will prepare your Vendors Statement, also known as a Section 32, together with a Contract of Sale
  • At this point we will also prepare the Early Release of Deposit Statement (Section 27), which allows you to have access to the deposit money before Settlement. (conditions apply)
  • We will also prepare the Discharge of Mortgage Application, (if required), for you to complete and return to our office, to be ready once a sale has taken place
  • We will send your Agent copies of the Contract and s.32, so they can forward to any prospective Purchasers, before an offer is made. 
  • We will perform an in-house Verification of Identity of all registered owners on Title.



Exchange of Contracts


  • Once the Purchaser's offer has been accepted by you and the contract has been signed by all parties, your Agent will send a copy of the contract to our office
  • We will write to you to confirm that we have received the fully signed Contract of Sale.



Post Contract


  • At this stage, we will serve the s.27 Early Deposit Release on the Purchaser, (unless your Agent already has), and notify your Lender that your property has sold by sending them the completed Discharge of Mortgage application, once received back from you
  • Negotiate and confirm reasonable extensions of time requested by the Purchaser necessary to fulfill conditions of  the contract, such as finance approval extension, (you don't have to agree to these extensions of time, however the Contract will usually terminate
  • Advise you and your agent when the contract becomes unconditional
  • Follow up on s.27 Early Release of Deposit (when applicable)
  • Once the Statement of Adjustments has been received from the Purchaser's Conveyancer, we will double check that the figures are correct and send you a copy for your perusal
  • We will in-turn ask your lender for the discharge of mortgage payout figure
  • We arrange settlement with all relevant parties
  • We arrange for payment of the proceeds of sale as per your directions
  • Settlement is completed through the PEXA workspace

** Please Note:  The day before settlement, you should give the keys to your Agent. 

     The Purchaser should receive the property in the same condition as at the time they made the     offer,  except for fair wear and tear.  (this also means that any rubbish should be removed).




Post Settlement


  • Advise you that settlement has been effected
  • Email/Phone Agent authorising them to release the keys to the purchaser
  • Prepare documentation for notifying the relevant authorities of the change of ownership
  • Provide you with our Tax Invoice and a copy of the settlement statement including statement of adjustments.

 Private Sale (with Agent)     $700.00 +GST (including disbursements)

 Auction Sale                                 $800.00 +GST (including disbursements)


Our Fees/Charges will cover the following:


  • Verification of Identity in our office
  •  Preparing the Section 32 (Vendors Statement)
  •  Preparation of Contract of Sale
  •  Title searches (1 Title)* including other relevant searches/Certificates (Auction)
  •  Preparing the s.27 early release of deposit form
  •  Preparation of the Mortgage Discharge Authority application
  •  Liaising with your Mortgagee for discharge and deposit release information
  •  Requesting that the deposit is released (when applicable)
  •  Ordering the ATO Foreign Residents Capital Gains Withholding Clearance Certificate (if applicable)
  •  Liaising with the Buyer’s Conveyancer and checking the Statement of Adjustments
  •  Preparing/forwarding documents to you that require signing
  •  Setting up the PEXA workspace
  •  Advising Council, Water Authorities and Owners Corporations that ownership has changed (after settlement).



Possible Additional Fees/Costs:


  • Title Searches for Multiple Titles (cost per additional title) $20.00
  • Owners Corporation Certificate (if required) $155.00 (Vendor to order from Owners Corporation Manager)
  • Verification of Identity by a Third Party (i.e Aust. Post $40-$50)  
  • Cancelled Settlement/rebooking fee (including changes to adjustments) $50.00 
  • Licence Agreement prepared by our office (if requested by you) $200.00
